The following terms and conditions are in place for wedding photography only if you wish to view my general terms and conditions for all other photography, retouching services and products, they are available here:
Please read these terms and conditions carefully - In the following terms "JHS" and "their" shall mean Jordan Hayes Studio. "The client(s)" shall be those persons defined as bride and groom in the wedding booking form. It is mutually agreed that the following terms of agreement form an integral part of your wedding contract and that no variation or modification of your contract shall be effective unless accepted by bothJHS, and the client(s), in writing.
JHS only collects and accesses information that you voluntarily provide via email or through other direct contact initiated by you through the site. JHS will not sell or otherwise distribute these details to any other individual or entity. JHS is the sole manager of such information collected on the site.
DEPOSIT & PAYMENT
A non-refundable deposit of £250 is required at the time of booking, together with a signed contract. Dates are reserved only when the deposit is paid by cash, cheque, or bank transfer. Please make cheques payable to Jordan Hayes.
An unconditional refund policy exists for a period of 14 days from receipt of this contract and payment.
The deposit will be deducted from the cost of the client(s) chosen package when calculating the final balance due.
The client(s) may cancel their contract at any time by giving written notice to JHS but in doing so shall forfeit any monies paid. Cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing.
Should the cancelled wedding turn out to be a postponement, then, subject to JHS being available, all money paid may be applied to the new wedding. In this case, the total fees chargeable will be the fees, which apply at that time.
In the event of JHS taking another wedding booking for the client(s) cancelled or postponed date a full unconditional refund of your deposit and any other payments will be made.
COPYRIGHT & EXCLUSIVITY
The copyright Designs and Patents Act 1988 assign the copyright of the images to JHS. JHS shall be granted the right to use any media captured. JHS can use any media captured to promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.
JHS shall be the sole professional photographer at the venues specified in the wedding booking. JHS does however positively encourage family, friends and other guests to take photos throughout the day.
JHS shall be granted artistic licence in relation to the poses photographed and the locations used. JHS judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the changes of weather and the availability and willingness of subjects JHS will do their best to honour requested content but it may not be possible to capture all the images requested or to capture any specific event or happening.
It is beneficial to assign a person from the wedding party to inform the photographer 10 minutes before any major event throughout the day.
For a booking involving a church ceremony or at certain venues, the photographer’s movements can be restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
In the unlikely event of equipment failure beyond JHS control, their liability shall be limited to a refund of all monies paid minus expenses.
In the unlikely event of JHS being unable to attend your wedding due to unforeseen circumstances, JHS reserves the right to appoint another photographer to attend your wedding on behalf of JHS to undertake the wedding photography to their best ability.
PRODUCT DELIVERY & STORAGE
Product delivery will take a minimum of 2 months from your wedding day. JHS does not guarantee final delivery within any timescale.
Once the client(s) have received their images it is the client(s) responsibility to back up all files. JHS will store the client(s) wedding photos for a maximum of 3 months before archiving the images. JHS cannot be held liable for any loss of images after delivery.
